The duties of the Board include the authority to hear appeals from the decisions of the building code official. All hearings by the Board are open to the public. The appellant, the appellants representative, the code official and any person whose interest are affected shall be given an opportunity to be heard.

The local appeals board shall render a decision within five (5) working days after the hearing. The board may uphold, amend or reverse the decision of the local code official. The local Board’s decision may be appealed to the State Department of Housing, Building and Construction and an appeal from their decision may be made to Daviess Circuit Court.

The Owensboro-Daviess County Building Code Appeals Board shall consist of five (5) members.. Two (2) members shall be appointed by the mayor and with the approval of the Owensboro City Commission and two (2) members shall be appointed by the County Judge-Executive with the approval of the Daviess County Fiscal Court. One (1) member shall be appointed jointly by the Mayor and County Judge Executive, with the approval of the respective legislative bodies. The members shall serve for a term of four (4) years and may be re-appointed for consecutive terms.
